Describe the relationship correctly
The Korean Personal Information Protection Commission warns foreign businesses against collapsing provision and consignment into a generic sharing label. That distinction matters when an AI lab receives a corpus for its own training rather than acting only on the supplier’s instructions. Draw a purpose-and-control diagram: who collected the data, who determines the training task, who can reuse the results, and who authorises onward access? Have Korean counsel classify the actual arrangement.
Prepare the overseas-transfer facts
PIPC materials identify cross-border-transfer obligations under Article 28-8 and related requirements concerning disclosure and protective measures. Gather the destination, recipient entity, categories of data, method of access, retention period, and transfer purpose. Include remote review and onward provision to another country in the map. Do not assume a foreign laboratory falls outside PIPA solely because it has no Korean office; the regulator publishes guidance specifically for foreign business operators.
Build a Korean-language evidence trail
For Korean speech, text, or community datasets, preserve the original contributor notices and permission language. A translated summary helps a buyer review the pack but should not replace the source terms. Document dialect coverage, segmentation choices, transcription quality, and exclusions separately from privacy claims. If children’s material or sensitive information appears, isolate it for specialist review rather than including it in a general sample.
- Identify provision versus processing consignment for each recipient.
- Prepare a clear record of the transfer basis counsel selects.
- Define Korean-language handling of rights requests and complaints.
- Offer synthetic examples while permission and transfer questions remain open.
Review before release
Sources reviewed on 19 October 2026. This is a preparation checklist, not legal clearance, tax advice, or confirmation that an AI lab accepts suppliers from this jurisdiction. Ask qualified local counsel to review the actual dataset, collection history, proposed training purpose, recipient, and current rules before releasing personal data.
